Have you been illegally charged fees by your High School for Pep & Cheer, Band, Field Trips, ASB cards etc?
Since Prop 13 was passed back in 1978, school districts have been engaged in “Illegally Charging” students for fees associated with Pep & Cheer (uniforms, camps, coachs fees, trips, etc), Band (uniforms, instrument rentals, trips, etc).
These fees are 100% illegal and the school districts know it. The school districts of Los Angeles, Pasadena, Ramona, Madera, and several other districts have been sued and lost in court and have refunded hundreds of thousands of dollars back to the students that they “illegally charged” them for.
Many school districts keep charging these fees hoping that the citizens of California are too afraid of standing up to them. California Code of Regulations Title 5, Section 350 specifically prohibits these fees.
The CA Supreme Court Hartzell vs Connell in 1983 ruled that charging these fees violated the California Constitution Article 9 section 5′s free education clause for anyone under the age of 18. Check out…
